These Terms and Conditions (the “Terms”) govern your access to and use of missioncocktails.com and any related webpages, online storefronts, customer accounts, forms, content, features, and services operated on behalf of Mission Craft Cocktails (collectively, the “Site”), as well as purchases made through the Site.

The Site is operated by Mission Craft Cocktails, doing business as Mission Craft Cocktails (“Mission Craft Cocktails,” “Mission,” “we,” “us,” or “our”). Please replace every bracketed field in these Terms before publishing them.

By visiting the Site, creating an account, submitting information, placing an order, or otherwise using the Site, you agree to these Terms and to any policies incorporated by reference, including our Privacy Policy, Shipping Policy, and Refund Policy. If you do not agree, do not use the Site.

1. ELIGIBILITY AND LEGAL DRINKING AGE

The Site markets and sells alcoholic beverages and is intended only for adults who are at least 21 years old in the United States and otherwise of legal drinking age in the jurisdiction from which they access the Site or receive products.

By entering or using the Site, creating an account, or purchasing products, you represent and warrant that:

• You are at least 21 years old and legally permitted to purchase, possess, receive, and consume alcoholic beverages in your jurisdiction.
• You are not purchasing alcohol for a person who is underage or legally prohibited from receiving it.
• You will provide truthful and accurate age, identity, billing, shipping, and contact information.
• Your use of the Site and purchase or receipt of products will comply with all applicable laws.

An age gate on the Site does not replace any age or identity verification required at checkout, shipment, delivery, or pickup. We and our sellers, processors, fulfillment partners, carriers, and delivery providers may require government-issued identification and may refuse or cancel a transaction when age, identity, eligibility, or delivery requirements cannot be verified.

2. THE ONLINE STORE AND SELLER OF RECORD

The Site is hosted on Shopify and may use Shopify and other third-party services to provide storefront, account, checkout, payment, analytics, security, fulfillment, and customer-service functionality.

Alcohol sales and shipments are subject to federal, state, and local licensing requirements. Depending on your location and the fulfillment arrangement for a particular order, the seller of record may be Mission Craft Cocktails or a properly licensed third-party retailer or fulfillment partner. The applicable seller, fulfillment terms, shipping availability, taxes, fees, and restrictions may be shown during checkout or in related order communications.

Nothing on the Site constitutes an offer to sell alcohol where the sale, shipment, delivery, possession, or consumption of the product would be unlawful.

3. CHANGES TO THESE TERMS

We may revise these Terms from time to time. The version posted on the Site will state its effective date. Changes become effective when posted unless a later date is stated or applicable law requires additional notice.

Your continued use of the Site after revised Terms become effective means that you accept the revised Terms. Changes will not apply retroactively where prohibited by law.

4. CUSTOMER ACCOUNTS

You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account. You may not create an account for another person, impersonate another person, use false information, or allow an underage person to use your account.

We try to present product descriptions, ingredients, alcohol content, bottle sizes, availability, photographs, colors, packaging, serving suggestions, prices, and other information accurately. However, packaging, labels, colors, ingredients, formulations, vintages, availability, and other product details may change. Images are illustrative, and displays may affect how colors and packaging appear.

You should review the product label and packaging received before consuming a product. Information on the Site is not medical, dietary, or nutritional advice. Contact a qualified professional regarding allergies, sensitivities, medical conditions, medication interactions, pregnancy, or other health concerns.

We may correct errors, inaccuracies, or omissions and may update product information at any time, including after an order is submitted. If a material error affects an accepted order, we may contact you, cancel the affected item, or issue an appropriate refund.

6. ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase the products in your cart. An automated confirmation means that we received the order; it does not necessarily mean that the order has been accepted or is eligible for fulfillment.

We or the applicable seller of record may accept, reject, limit, hold, or cancel an order for reasons including:

• Product unavailability or inventory errors.
• Pricing, product-description, promotional, or technical errors.
• Payment authorization failure or suspected fraud.
• Inability to verify age, identity, billing information, or shipping eligibility.
• Alcohol licensing, shipping, carrier, delivery, or geographic restrictions.
• Orders that appear to be placed by unauthorized resellers, distributors, or commercial purchasers.
• Quantity limits or other restrictions stated on the Site.
• A violation or suspected violation of these Terms or applicable law.

If we cancel an order after payment has been captured, the appropriate amount will be refunded to the original payment method, subject to processing times outside our control.

7. PRICES, PAYMENT, TAXES, AND FEES

Unless otherwise stated, prices are shown in U.S. dollars and do not include applicable taxes, shipping charges, delivery fees, service fees, bottle deposits, or other charges. The total amount presented at checkout may vary based on your shipping address, seller of record, product availability, applicable law, and selected delivery method.

By providing a payment method, you represent that you are authorized to use it and authorize the applicable seller, Shopify, and payment processors to charge the total amount shown at checkout, including applicable taxes and fees.

You agree to provide accurate billing and payment information. We may use third-party services to authorize payments, verify information, prevent fraud, and manage chargebacks. We are not responsible for fees charged by your card issuer, bank, or payment provider.

Discounts and promotions cannot be combined unless expressly stated. We may correct pricing or promotional errors and may cancel orders affected by an obvious error.

8. SHIPPING, DELIVERY, AND ADULT SIGNATURE

Products may be shipped or delivered only to locations where legally permitted and where service is available. Available destinations, methods, estimated timing, charges, and restrictions may be presented at checkout and may change.

You are responsible for providing a complete and accurate delivery address where an eligible adult can lawfully receive the shipment. Alcohol shipments may require an adult signature and presentation of valid government-issued identification showing that the recipient is at least 21 years old. Carriers generally may not leave alcohol shipments unattended, at a post-office box, or with an underage recipient.

Delivery estimates are not guarantees. Weather, carrier conditions, legal restrictions, inventory, verification issues, holidays, and events outside our control may cause delays. Neither Mission nor the applicable seller is responsible for delays caused by inaccurate information, failed delivery attempts, the absence of an eligible adult, or events outside reasonable control.

Additional fees may apply when a shipment must be redirected, returned, reshipped, or disposed of because the address was inaccurate, delivery was refused, or an eligible adult was unavailable. Any reshipment is subject to law, product condition, inventory, and payment of applicable charges.

9. TITLE, RISK OF LOSS, AND DAMAGED SHIPMENTS

Title and risk of loss pass as provided by the applicable seller’s checkout terms and governing law. Nothing in this section limits rights that cannot lawfully be waived.

Inspect your shipment promptly. If products arrive damaged, defective, incorrect, leaking, or otherwise affected, contact us through https://missioncocktails.com/pages/contact within [NUMBER] days of delivery and include the order number, a description, and clear photographs of the product and shipping packaging. Do not discard the product or packaging until instructed, as they may be needed to evaluate the claim.

10. RETURNS, REFUNDS, AND CANCELLATIONS

Alcohol and other consumable products may be subject to special return and refund restrictions. Orders may enter fulfillment quickly and may not be cancellable or editable after submission.

Returns, replacements, refunds, damaged-order claims, and cancellation requests are governed by our Refund Policy at [REFUND POLICY URL] and any terms disclosed during checkout. Nothing in these Terms limits any non-waivable consumer right.

Refunds approved by us or the applicable seller will generally be issued to the original payment method. Financial institutions and payment providers control the time required for a credit to appear.

12. CHARITABLE AND “POUR IT FORWARD” PROGRAMS

The Site may describe charitable contributions or social-impact programs, including statements that purchases help fund meals through food-bank partners. Such statements may rely on contribution formulas, estimates, reporting periods, minimum commitments, partner-provided equivalencies, or other program terms described on the Site or in campaign materials.

Charitable partners, contribution amounts, campaign periods, formulas, and programs may change. Unless expressly stated otherwise, your purchase is a commercial purchase from the applicable seller and is not a charitable donation by you or eligible for a charitable tax deduction. Mission Craft Cocktails is responsible for making any contribution it expressly promises, subject to the disclosed program terms.

Third-party charitable names and marks belong to their respective owners. Reference to a charitable organization does not imply endorsement beyond the applicable relationship or campaign.

13. LIMITED LICENSE AND INTELLECTUAL PROPERTY

The Site and its content—including product names, trademarks, logos, artwork, labels, packaging, photographs, graphics, video, audio, text, recipes, designs, software, layout, and other materials—are owned by or licensed to Mission Craft Cocktails and are protected by intellectual-property laws.

Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for your personal, lawful, noncommercial use.

Without our prior written permission, you may not:

• Copy, reproduce, modify, distribute, publish, display, sell, license, or create derivative works from Site content.

• Reverse engineer, decompile, disassemble, or attempt to derive source code from Site software, except where such restriction is prohibited by law.
• Remove copyright, trademark, or proprietary notices.

No right or license is granted by implication, estoppel, or otherwise except as expressly stated.

14. COPYRIGHT COMPLAINTS

If you believe material on the Site infringes your copyright, send a notice containing the information required by the Digital Millennium Copyright Act to:

15. REVIEWS, FEEDBACK, AND USER CONTENT

The Site may allow you to submit reviews, photographs, comments, questions, suggestions, testimonials, contest entries, or other content (“User Content”). You retain ownership of User Content you own, but you grant Mission Craft Cocktails and its service providers a worldwide, nonexclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, adapt, publish, translate, display, distribute, and otherwise use the User Content in connection with operating, improving, promoting, and marketing Mission Craft Cocktails and the Site, in any media, subject to applicable law and our Privacy Policy.

You represent and warrant that you have all rights needed to submit the User Content and grant this license; the User Content is accurate when presented as factual; and its use will not infringe or violate another person’s rights or any law.

You may not submit User Content that is unlawful, fraudulent, misleading, defamatory, threatening, harassing, hateful, obscene, infringing, invasive of privacy, commercially promotional without permission, or infected with malicious code.

• Use bots, spiders, scrapers, data-mining tools, or automated systems to access the Site without written permission.
• Impersonate any person or organization or submit false or misleading content.
• Harass, threaten, abuse, discriminate against, or harm another person.

MISSION CRAFT COCKTAILS AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, SELLERS, AND FULFILLMENT PARTNERS DISCLAIM, TO THE FULLEST EXTENT PERMITTED BY LAW, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ACCURATE, COMPLETE, CURRENT, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.

TO THE FULLEST EXTENT PERMITTED BY LAW, MISSION CRAFT COCKTAILS AND ITS PARENTS, AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, SELLERS, AND FULFILLMENT PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF MISSION CRAFT COCKTAILS FOR CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID THROUGH THE SITE FOR THE PRODUCT OR TRANSACTION DIRECTLY GIVING RISE TO THE CLAIM.

THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.

23. INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Mission Craft Cocktails and its affiliates, owners, officers, directors, employees, agents, licensors, service providers, sellers, and fulfillment partners from claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your unlawful use of the Site, your User Content, your violation of these Terms, your violation of another person’s rights, or your purchase or provision of alcohol for an ineligible recipient.

This obligation does not apply to the extent a claim results from the indemnified party’s own unlawful conduct or where indemnification is prohibited by law.

24. GOVERNING LAW AND VENUE

These Terms and any dispute arising from them or the Site are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent federal law applies or applicable consumer law requires otherwise.

Subject to any non-waivable right to bring a claim elsewhere, you and Mission Craft Cocktails agree that disputes will be brought in the state or federal courts located in USA, California, and consent to their personal jurisdiction and venue.

Before filing a lawsuit, the parties are encouraged to contact one another and attempt in good faith to resolve the dispute informally. This informal process does not prevent either party from seeking urgent injunctive relief or filing within an applicable limitation period.

25. TERMINATION AND SUSPENSION

These Terms remain effective while you use the Site. You may stop using the Site at any time.

We may suspend or terminate your access, account, or ability to purchase when we reasonably believe you have violated these Terms, created legal or security risk, engaged in fraud or misuse, or are ineligible to use the Site. Provisions that by their nature should survive termination—including intellectual-property, User Content license, disclaimer, limitation of liability, indemnification, dispute, and miscellaneous provisions—will survive.
